Texas requires the exact all-caps disclosure 'THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.' (updated by SB 541, effective Sept 1, 2025). Annual gross income cap is $150,000; online sales are allowed with personal delivery, and expanded 2025 rules permit indirect/retail sales through registered vendors.

Permits & training: No general permit or license required. Registration with DSHS is mandatory for producers selling time/temperature-control-for-safety (TCS) foods and for vendors reselling TCS cottage foods; registration also yields a DSHS ID number that may replace the home address on labels. A food-handler certificate is required for the operator.
What goes on a Texas cottage label
- Common or usual name of the product
- Operation name and physical address (or DSHS-issued ID number)
- Major food allergens (milk, eggs, wheat, soy, peanuts, tree nuts, fish, crustacean shellfish, sesame)
- For TCS foods: date made and safe-handling instructions (min. 12-pt font)
- Batch number for pickled fruits, fermented vegetables, or acidified canned goods
